Smart Fax is operated by Smart Mobile Apps FZCO ("Smart Fax", "we", "us"), Dubai, United Arab Emirates. This Privacy Policy describes what information the Smart Fax application for iPhone and iPad (the "App") collects, how it is used, who receives it and the choices you have. It is written to be read together with our Terms of Use.
Everything you scan, sign, import or edit in Smart Fax is processed on your iPhone or iPad. A document leaves your device only when you tap Send: it then travels over an encrypted connection to our server and on to our fax transmission provider, which delivers it to the fax number you entered. We:
— do not read or review the content of your faxes;
— do not store the documents you fax in our database;
— never use the content of your faxes for analytics or advertising;
— do not sell your personal data.
The App works without registration: no account is required, and we do not ask for your email address.
When you tap Send, the App sends to our server, which runs on Google Cloud:
— the document as a PDF file: the pages you scanned, the photos or files you selected and any signature you added;
— the recipient's fax number;
— the sender name and phone number, if you entered them;
— the identifier of your installation of the App and an identifier of the fax.
Our server checks our anti-abuse limits and passes the document, the recipient's number and the sender details to our fax transmission provider, which dials the recipient and reports the delivery status that the App shows in History.
Our database keeps a record of each fax together with your installation identifier: the recipient's fax number, the sender name and number, the number of pages, the status, the time and a reference to the fax at our provider. We use these records to deliver faxes, show their status, apply page limits, prevent abuse and handle complaints. Our provider keeps transmission records and may keep copies of transmitted documents for a limited period under its own policies.
Faxes travel over the public telephone network, where they are not encrypted, and the recipient's machine or service may store, print or forward what it receives. Please check the number before you send.
The App asks for access to data on your device only when you use the related feature:
— Camera, to scan paper documents;
— Photos, to fax pictures you choose;
— Contacts, to pick a fax number from your address book. The App does not upload your address book; only the number you fax to leaves the device;
— Files and iCloud Drive, to fax documents you select;
— Notifications, to tell you when a fax has been delivered or has failed. These notifications are created on your device.
Your documents, scans, signatures, fax history and settings are stored in the App on your device and may be included in your iCloud or computer backups. You can delete them in the App, and deleting the App removes them. A random installation identifier is stored in the iOS Keychain so that we can apply page and anti-abuse limits; it may remain on the device after the App is deleted. You can review or revoke permissions at any time in iOS Settings; the App keeps working with the sources you allow.
You can optionally connect Dropbox or Microsoft OneDrive to fax files stored there. You sign in directly with the provider; we never see your password. The App receives an access token, which is stored on your device only, and downloads the files you open to your device. We do not copy your cloud files to our servers, except the files you choose to fax, and the App does not change or delete files in your cloud storage. You can revoke the App's access at any time in your account settings with the provider. Your use of these services is governed by their own privacy policies.
To keep the App working and improve it, we collect a limited amount of technical statistics:
— app diagnostics: app version, crash reports and errors;
— device technical information: device model, iOS version, app language, and the country or region derived from your IP address;
— usage statistics: which screens and features are used, for example a tap on Send, a fax accepted for sending or a subscription screen shown;
— random identifiers that our analytics services create for your installation, and the iOS identifier for vendor (IDFV).
Our server also stores the device model, the device name as reported by iOS, the iOS version and the app version with your installation record to help diagnose problems. Versions up to 4.2 download a settings file from our web hosting, which records your IP address in its access logs.
We use these statistics to understand how the App is used as a whole and to fix errors, not to contact you. The content of your faxes is never included. In versions up to 4.2, the events about a fax also include the recipient's fax number and the sender name and number; we are removing them in the next update.
The App shows no third-party advertising. In versions up to 4.2, the App includes install-attribution tools that measure which of our ad campaigns bring installs and subscriptions. They receive install and launch events, the usage events described above (in these versions including the fax numbers and sender name in fax events), purchase events (product, price and currency), technical device data and IP address. They receive your device's advertising identifier (IDFA) only if you grant the iOS App Tracking Transparency permission; if you decline, the App works exactly the same. These partners process this data under their own terms and privacy policies.
Starting with version 4.3, the App includes no install-attribution tools, does not ask for permission to track you and does not share your advertising identifier.
Premium subscriptions are purchased through Apple In-App Purchase and are billed to your Apple Account. Payments are processed entirely by Apple: we never receive or see your payment card details, billing address or Apple Account credentials. We receive only the transaction information necessary to activate and maintain your subscription (product, purchase and expiry dates, transaction identifiers and renewal status), and we store the type and purchase date of your subscription with your installation record to apply page limits. The App checks your subscription and page limit before sending; in an upcoming update our server will also check with Apple that your subscription is active before a fax is sent.
Fax services attract junk faxes and fraud. To protect recipients, our users and the service, we limit the number of pages, the number of faxes per day and the number of faxes in progress at the same time, temporarily pause sending after repeated failed attempts, and may block an installation or a recipient number that is used for abuse, or a number whose owner has asked us to. When we receive a complaint, we review the fax records described above and may share relevant records with our provider, telecom carriers or authorities.
Smart Fax is a general-purpose fax app for consumers and small businesses. It is not designed for use regulated by HIPAA or similar health-privacy laws: we do not sign business associate agreements and do not claim compliance with HIPAA, PHIPA, PCI DSS or ISO 27001. You decide what to send; if a document contains health information, payment card data or other specially protected information, consider whether faxing it with the App is appropriate for you.
We use a small number of third-party providers to process data on our behalf: backend hosting and database, fax transmission, analytics and crash reporting, web hosting, the email service of our support mailbox and, in versions up to 4.2, install attribution. Some of them may process data in the United States and other countries; where the law requires, these transfers rely on safeguards such as Standard Contractual Clauses. A current list of providers is available on request via the contact below.
Apart from these providers, we share data only with the recipient of your fax, who receives your document and sender details; with telecom carriers that route fax calls; with authorities or courts when the law requires it or to investigate junk-fax and fraud complaints; and with a successor if the App is transferred, on condition that this Policy continues to protect your data. We do not sell personal data.
We keep personal data only as long as it is needed for the purposes in this Policy: fax records and your installation record for as long as needed to deliver faxes, apply page limits, prevent abuse and handle complaints; support emails for as long as needed to handle your request; analytics and crash data within the retention settings of each provider's service. We delete data on request unless we must keep it to investigate abuse, to establish or defend legal claims or to comply with the law.
If you are located in the European Union, United Kingdom, or a jurisdiction with similar data protection laws (including the GDPR, UK GDPR and CCPA), you have the right to access, correct, delete, restrict or object to processing, to data portability, and to opt out of the sale or sharing of personal data. The App has no accounts, so we cannot find your data by your name or email: to exercise a right, write to the contact below with the approximate date you installed the App or bought your subscription, your device model and, if you can, the sender number you used. We will find the records we can and respond within one month. Deleting the App does not delete data held on our servers, so please send us a deletion request. You also have the right to lodge a complaint with your local supervisory authority.
We process personal data to provide the service you asked for (sending faxes, subscriptions and support), for our legitimate interests in security, abuse prevention, analytics and crash reporting, to comply with the law and, in versions up to 4.2, with your consent to tracking, which you can withdraw at any time in iOS Settings > Privacy & Security > Tracking.
The App is intended for adults and is not directed at children. We do not knowingly collect personal data from children; if you believe a child has provided data through the App, contact us and we will delete it. Purchasing a subscription requires the legal capacity to enter into a contract in your jurisdiction.
Documents travel from the App to our server over encrypted connections, and the limited data we store is protected with industry-standard safeguards. Fax transmission over the telephone network itself is not encrypted, and no system is completely secure. If a security incident affects your data, we will notify you and the authorities where the law requires.
We may update this Policy from time to time. The current version is always available at this address, with the "Last updated" date above. Material changes will be announced in the App or in the App Store release notes.
