Smart Fax — Terms of Use

Last updated: September 28, 2026

1. AGREEMENT

These Terms of Use (the "Terms") are an agreement between you and Smart Mobile Apps FZCO ("Smart Fax", "we", "us"), Dubai, United Arab Emirates, and govern your use of the Smart Fax application for iPhone and iPad (the "App") and of the fax sending service provided through it (together, the "Service"). By installing or using the App you accept these Terms. If you do not agree, do not use the App. These Terms replace all earlier terms for the App.

You must be at least 18 years old, or the age of majority where you live, and able to enter into a binding contract, and the laws of your country or applicable sanctions laws must not prohibit you from receiving the Service. If you use the App on behalf of an organization, you confirm that you may accept these Terms for it.

2. THE SERVICE

Smart Fax lets you send faxes from your iPhone or iPad: scan paper, import photos and files, sign and combine pages on your device, and send them to fax numbers in supported countries. Faxes are sent through our server and a third-party fax transmission provider. The App sends faxes only; it does not receive them. The list of supported countries is shown in the App and may change. Faxes to satellite networks and known premium-rate numbers are blocked. Our Privacy Policy is part of these Terms.

3. PREMIUM SUBSCRIPTIONS AND PAGE LIMITS

Sending faxes requires a Premium subscription.

— Premium is offered as auto-renewable weekly, monthly or yearly subscriptions purchased through Apple In-App Purchase and billed to your Apple Account at confirmation of purchase. The price and period are shown before you confirm.
— A subscription renews automatically unless auto-renewal is turned off at least 24 hours before the end of the current period.
— You can manage or cancel your subscription at any time in your Apple Account settings. Uninstalling the App does not cancel a subscription. If you cancel, Premium stays active until the end of the period you have paid for.
— On devices signed in to the same Apple Account, tap "Restore" on the subscription screen to activate an existing subscription.
— If a free trial is offered, any unused portion of the trial is forfeited when you purchase a subscription.
— Subscriptions are not unlimited. You can send up to 50 pages per week, 200 pages per month or 2,500 pages per year, depending on your plan. Pages of a fax that fails are returned to your subscription page limit. Unused pages do not carry over. If a fax would exceed your remaining limit, the App tells you how many pages you have left.
— A single fax can include up to 50 pages. To prevent abuse, only a limited number of faxes can be in progress at the same time; daily limits on the number of faxes and pages apply per device, per subscription and per recipient number, as well as overall daily capacity limits of the Service; and sending may be paused temporarily after repeated failed attempts.
— Refunds for purchases made through the App Store are handled by Apple under the App Store terms. You can request a refund from Apple at reportaproblem.apple.com.

4. ACCEPTABLE USE AND JUNK FAX RULES

You may use the Service only for lawful purposes, and you are responsible for every fax sent through your installation of the App. You agree not to:

— send unsolicited advertisements by fax without the recipient's prior express invitation or permission. In the United States this is prohibited by the Telephone Consumer Protection Act, as amended by the Junk Fax Prevention Act (47 U.S.C. §227), and by FCC rules (47 C.F.R. §64.1200); similar laws exist in other countries;
— send bulk or automated fax broadcasts, or use scripts, bots or multiple installations to get around page limits, subscription checks or anti-abuse limits;
— fax numbers you are not authorized to contact, or keep faxing a recipient who has asked you to stop;
— send content that is unlawful, fraudulent, threatening, harassing, defamatory or infringing, or that contains malware;
— impersonate any person or organization, or give false sender information;
— use the App for emergency communications;
— interfere with the Service or our provider's systems, or copy, modify, reverse engineer or decompile the App, except where the law allows it.

You must also comply with the laws of your country and of the recipient's country.

5. SENDER IDENTIFICATION

US law (47 U.S.C. §227(d) and 47 C.F.R. §68.318(d)) requires every fax to show, at the top or bottom of each page or on the first page, the date and time it is sent, the identity of the sender and the telephone number of the sender or of the sending machine; similar rules exist in other countries. Enter your real name or your organization's name, and a telephone number at which you can be reached, in the sender fields of the App. These details are sent with your fax; if they are not added to the fax automatically, make sure your document shows them, for example on the first page. You are responsible for their accuracy.

6. COMPLAINTS AND ENFORCEMENT

If you received an unwanted fax sent with Smart Fax, write to us at the address in section 16 with the date and time of the fax and the receiving number. At our discretion and without prior notice, we may delay, refuse or stop a fax; block a recipient number whose owner has asked not to receive faxes sent with the App; pause sending after repeated failed attempts or suspicious activity; suspend or block an installation that we reasonably believe breaches these Terms; and share relevant records with our provider, telecom carriers or authorities as described in the Privacy Policy. If we block your installation for a breach of these Terms, you are not entitled to a refund from us, to the extent permitted by law.

7. YOUR CONTENT

You retain all rights to the documents and other content you send with the App. You grant us and our service providers a limited permission to process, transmit and temporarily store your content only as needed to provide the Service and to comply with the law; we claim no ownership of it. You are responsible for having the right to send the content and for checking the recipient number: we are not responsible for faxes sent to a wrong number that you entered.

The App is not designed for use regulated by HIPAA or similar health-privacy laws: we do not sign business associate agreements and do not claim compliance with HIPAA, PHIPA, PCI DSS or ISO 27001. You decide what to send.

8. FAX DELIVERY, NETWORKS AND THIRD-PARTY SERVICES

Fax delivery depends on telephone networks, our provider and the recipient's equipment or service, which we do not control. We do not guarantee that a fax will be delivered, when it will be delivered, or how legible it will be. The "Sent" status means that our provider reported a successful transmission to the receiving number; it does not confirm that a particular person has read the fax. The Service may be unavailable from time to time because of maintenance, provider outages or other reasons beyond our control. Cloud services you connect (such as Dropbox or Microsoft OneDrive) are provided by third parties under their own terms and privacy policies; we are not responsible for their availability or content.

9. INTELLECTUAL PROPERTY

The App and all related content (excluding your content) are owned by Smart Mobile Apps FZCO or its licensors. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, as permitted by the App Store terms.

10. APPLE

These Terms are between you and Smart Mobile Apps FZCO only, not with Apple Inc. Apple has no obligation to provide maintenance or support for the App and is not responsible for the App or its content. In the event the App fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. We, not Apple, are responsible for addressing any claims relating to the App, including product liability, legal and regulatory compliance and intellectual property claims. You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. DISCLAIMER AND LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, the App and the Service are provided "as is" and "as available", without warranties of any kind, express or implied. We are not liable for faxes that were not delivered, were delayed or were sent to a wrong number, or for indirect or consequential losses. To the same extent, our total liability for any claims arising out of or relating to the App or the Service is limited to the amount you paid us for the App in the 12 months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

12. INDEMNITY

To the extent permitted by law, you agree to indemnify Smart Mobile Apps FZCO and its service providers against claims, fines and costs, including reasonable legal fees, arising from faxes you send in breach of these Terms or the law, in particular claims under junk-fax laws.

13. TERMINATION

You may stop using the App at any time; to stop payments, cancel auto-renewal in your Apple Account settings. We may suspend or terminate your access to the Service if you materially breach these Terms, if required by law or by our provider, or to prevent harm to others. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability and indemnity) survive.

14. CHANGES TO THESE TERMS

We may update these Terms from time to time. The current version is always available at this address, with the "Last updated" date above. Material changes will be announced in the App or in the App Store release notes. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

15. GOVERNING LAW

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law rules, and any disputes shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE — except where the mandatory consumer protection laws of your country of residence provide otherwise.
